ACTUAL PROBLEMS OF THE LEGAL NATURE OF CRIMINAL OFFENSES IN LAW ENFORCEMENT PRACTICE
Abstract
Abstract. In this article, topical issues related to the use of criminal offenses in criminal legislation were considered. In addition, the article provides a comprehensive description of the features of criminal offenses that distinguish them from crimes and administrative offenses, the concept of criminal offenses, and also focuses on the actual problems of applying criminal offenses in theory and law enforcement practice in the study. Statistical data on criminal offenses are also presented, in particular, an analysis of each criminal offense in a special part of the Criminal Code, as well as the types of penalties for committing criminal offenses, in a special part of the Criminal Code of the Republic of Kazakhstan, norms that contradict the application of criminal offenses are identified. On the basis of the conducted scientific research, specific problems are identified in law enforcement practice, indicating conflicting norms of the criminal code. In addition, the article presents ways to solve topical issues related to the use of criminal offenses in criminal law.
